most for failure to disperse. >> about 100 people marched in san francisco yesterday to show what they call solidarity with protestors in ferguson, missouri. [ screaming ] >> the so-called day of rage protest caused traffic snags in several parts of town. but there were no major reports of problems. there is a vigil this morning for a man who died in san francisco during a confrontation with police. kpix 5's anne makovec joins us live from the site of that vigil. anne. >> reporter: you can see this man's picture alex nieto on the sign behind me advertising one of two protests planned for today. there was a sunrise ceremony that started here at bernal heights park at 5 a.m. it is in honor of this man, 28- year-old alex nieto who was shot and killed by police five months ago. it happened at the top of the hill here at bernal heights park where protests are going on this morning. it was a friday night at about 7 p.m.

police got a report of a man look suspicious. they arrived. officers say nieto pulled a taser on them and they thought it was a gun. i asked one of the protestors this morning what justice in their opinion would look like. >> these officers that were, uhm, involved in the shooting get reprimanded for what they did. they don't deserve to be part of the force and i think i that some policy changes need to happen, uhm. officers need to have better training now and actually think before they shoot, you know, it's just not justified. there's no reason for, uhm, alex to have lost his life. >> reporter: today lawyers for the family will file a federal civil complaint. they say a new witness has come forward in the case so they are starting a march here at the park at noon and heading to the federal building where lawyers will be filing that complaint. live in san francisco anne makevoc, kpix 5. >> questions are now being raised about a new video showing a bay area deputy punching a man.

the cell phone video shows the sonoma county deputy landing two punches while trying to restrain a man who was already down on the ground. video was captured by an eyewitness during the arrest last saturday but a police tactical expert says those punches were completely warranted. >> you have to remember whenever a police is in confrontation there's at least one gun involved the one they're wearing and you never know if a suspect is armed or not until you get him handcuffed and you do a search on him. >> a spokesman for the sonoma county sheriff's office says the deputies were using distraction jabs. it's a tactic to hit a person in different places in order to get a hold of their hands during an arrest. it is 6:03 right now. let's check the roads with elizabeth. >> thanks, guys. and it's a friday morning commute. it's definitely under way over at the bay bridge. heavy traffic especially for a friday. so the metering lights are on and they have been for 15 minutes. so now you are stacked up almost to the maze. kind of inching closer and closer as we speak. there was also that earlier fender-bender. they turned on the metering lights right after that happened right before 5:45.

so they were likely going to turn on the metering lights right around then anyway. so commuters are trying to get into san francisco from the east bay. also this crash was just cleared out of lanes westbound 580 approaching grant line road. it was involving a car and another motorcycle. so it doesn't sound like serious injuries. sounds like it's clearing now. there are some slight delays coming out of the altamont pass. if you are heading to the dublin interchange, it looks okay approaching 680 but once again that drive time is slow up to about 24 minutes along that stretch. that's your latest "kcbs" drive to work. looks like we have a heat wave, right, lawrence? >> next week things are heating you want. today the we may cool down slightly with patchy fog at the coastline, not as extensive for today, clear in many of the valleys but the sea breeze is blowing helping to cool down the temperatures just a little bit as high pressure weakens somewhat. 70s and low 80s inside the bay. 80s for the valleys. 60s with patchy fog along the coastline. out over the bay right now, we have a lot of clouds there.

the temperatures of 60 degrees in san francisco. 61 in livermore. and 61 degrees also into concord. this afternoon, we'll see sunny skies in most spot, cloudy at the coastline, 60s there. a lot of 70s a few low 80s inside the bay. about 82 degrees in concord. and 80 and sunny and bright in the napa valley. back to you. a new study suggests 63 trillion gallons of water have been lost to drought in the western u.s. that would be enough to blanket the region with 4 inches of water. uc-san diego researchers measured the level of the earth's crust with a network of gps stations. that network is normally used to predict earthquakes. the devices show the earth's crust has risen an average of 4 millimeters since last year! well, it's just dirt right now but by sunday afternoon, levi's stadium is expected to have a newfield of green grass for the 49ers. kiet do reports.

>> reporter: normally we would be able to look at the live tv cameras to tell you what he is going on but they are turned off for the first time 2.5 years. we have called in chopper 5. we have a half dozen people on the field right now. some tractors with rolls of sod. they are putting in that sod as we speak. yesterday afternoon crews were watering the soil and prepping the ground to be ready for this morning. they tore out the middle of the field. it's gone. workers are now installing a new but temporary thick cut sod. the concern is that given the constant beating this field will get, there's not enough time for the permanent grass to put down deep roots and survive the rest of the season. 10,000 fans who came out to watch the last open practice were disappointed when coach harbaugh took the players off the field when they started slipping and sliding yesterday. >> i noticed a couple times myself when a receiver would make a cut and it would be a big chunk of sod that would come up from their feet and we

also notice that stevie johnson fell near the end zone and he kind of came up limping and i think that really concerned the coaches. >> reporter: this is a live look again inside levi's stadium where they are putting in that sod right now. you know, back in april the turf grower bragged about the toughness of this bermuda strain saying it could withstand 300-pound linemen and divots would be nonexistent. anybody who puts in sod knows two days is not enough time for it to stay in place. we are wondering how it will stay in place for the sunday game. the 9ers say everything will be fine. >> they must have some special grass glue or something. god knows how that's going to stick down. hey, by the way, i guess this sod is used in some other parks and stadiums around the bay area. and it works pretty well, right? >> reporter: yeah. you know, it's been used pretty widely across the region. the raiders have used it. minor baseball team in sacramento has used it. also, both of san diego's teams

have used it as well and stanford has it there. so no big complaints that we have heard of. we'll have to wait and see how it goes. live at levi's stadium kiet do, kpix 5. >> hopefully a better football game, too, against the chargers. and don't forget we have the raiders and the packers kicking off tonight, 5:00, and that game is right here on kpix 5. the "5th quarter" will follow with dennis o'donnell and crew right after the game. some two-year colleges in california might be offering four-year degrees in the future. that's if governor brown signs a bill approved by the legislature yesterday. it would allow 15 community colleges to offer bachelor degree programs that are not available at other schools nearby. >> it's important for one reason that you get the opportunity at the community college. but also, what's important is community colleges are located almost everywhere. >> there is no word yet on what schools might be involved in the four-year degree program. documents show the remains of robin williams were cremated the day after he committed suicide. according to his death

dam. hagel said the group will likely regroup and launch a new offensive. a california supreme court has ruled that newspapers have the right to know and publish the names of all officers involved in a pepper spraying incident at uc-davis. that incident happened against student "occupy" protestors in 2011. a university police union tried to overturn a lower court ruling that allowed newspapers to publish officers' names. with the high court's ruling, the university system just released the names of 18 officers who were on scene during the event. a check of traffic now at 6:14 on a friday. are we light or in trouble? >> well, we're kind of somewhere in between. it's looking good at the bay bridge toll plaza. we could call it "friday light" for a while. unfortunately, they have this minor fender-bender right before the bay bridge toll plaza. that kind of turned on the metering lights a little bit early. not much.

just slightly. and anyway, so now you have a backup that extends into the macarthur maze. so it's pretty busy at least for a friday. sometimes we do see lighter traffic. we usually can sometimes say it's "friday light" but not today. it's stacked up across all lanes now at least the approaches still look good. you will notice that 580 commute still looks good no delay on 24, highway 13 or 880 actually coming from downtown oakland. here is a live look at the richmond/san rafael bridge. you see more cars on the road so far, so good heading into marin county from the east bay traveling westbound 580. and if you are traveling the nimitz, this is what it looks like once again near the oakland coliseum. taillights this is the commute direction northbound 880. so from 66 straight up to the macarthur maze, actually 238 to the maze, 15 minutes. through the livermore valley, we are seeing the usual slowdowns but slightly better than normal from the altamont pass and 680. with the forecast, here's lawrence. we have patchy fog now not as extensive as the last couple of days. we are going to see some cooler

temperatures. the sea breeze picking up. some of those winds to 30 miles per hour right in through the delta. still we are going to see a lot of sunshine into the afternoon. the clouds start to break up. boy, it's going to be a beautiful day inside the bay and the valleys. but temperatures going to come down two or three degrees and looks like the weekend should be great. high pressure going to strengthen overhead. our temperatures going to actually warm up a few more degrees. but today we have a weak low that's making its way just to our north. so that will be enough to reinforce the marine layer just a little bit along the coastline and bring that cool breeze. but with the breeze comes some very good air quality all around the bay area. you can breathe deeply the clean air. temperatures in the central valley 89 in sacramento, 99 and hot in fresno, 74 lake tahoe, 94 yosemite. sunshine around the bay this afternoon, in the 70s and 80s, maybe as high as 86 in morgan hill. 60s along the coastline. you will see a lot of 80s into the east bay. some 70s into the delta with that breeze. and inside the bay about 72 degrees in alameda.

good morning? >> everyone. the last five times a team won a protest, they went 0-5 in the resumed games. well, the giants with their second life looking to avoid making it 0 for 6. check it out. two-hour rain delay. at least they got the tarp on correctly. it was 2-0 cubs when the game resumed but then top 6 joe panik with a two-out rbi single. giants 2-1. pagan in the 9th inning tying run at second base but they stopped the comeback ever. he was out. that game went 9 hours 21 minutes and the cubs won 2-1. the nightcap belonged to madison baumgarner who had 12

a protest for a man shot and killed by police. i'm anne makovec live in san francisco with more on how the family plans to file a federal civil complaint today. >> we're seeing less fog around the bay area this morning but temperatures may be cooler. we'll talk about that coming up. >> and problems on northbound 880 near the oakland coliseum. chp had temporarily closed all lanes to clear a stall. a live report is coming up. good morning, everyone. it's friday, august 22. i'm frank mallicoat. >> i'm michelle griego. time now is 6:30. a husband and wife hot water accused one of the biggest used car scams in california history. christin ayers reports they were caught after on undercover operation in antioch. it's the biggest odometer tamping case in california -- tampering case in california history. reporter: leisha thought she was getting a car with 128,000 miles on it when she bought this used ford from her landlord's auto dealership. it wasn't until she had handed over the money, $3,200, that she realized she had been duped.

>> he had rolled back the odometer. >> reporter: a vehicle history report showed the car had nearly 100,000 more miles on it than the odometer showed. >> i was livid. i was livid. i trusted him. >> reporter: authorities say over the years the owners of jorge's california car sales, george and his wife danielle, had switched the odometers of up to 100 cars with lower mileage cars from junkyards. they are now facing 80 counts. workers at the dealership closed up shop when we knocked and even called police on us. a customer considering buying a car here changed her mind. >> turn the odometers back? i don't think i want to buy one here. >> reporter: leisha is cooperating with the d.a.'s office but says it is costing her. she claims the guevaras are now evicting her from the apartment she lives in on their lot. she is hoping justice is served. >> i'd like to see him go to jail. it's wrong to do that. >> reporter: christin ayers, kpix 5. >> george guevara is being held

on a million dollars bail. his wife danielle has been released. the 49ers say their new football field will be ready for sunday's big exhibition game. kpix 5's keit do at levi's stadium explains the turf trouble that has the field being ripped up. good morning, kiet. >> reporter: good morning. we have some footage taken from chopper 5 just a few moments ago that shows a half dozen workers on the field as we speak unfurling large rolls of turf installing it right now. we talked to the 9ers and they have assured us that on sunday they will be good to go. it's out with the new and in with something that wasn't in the game plan. yesterday afternoon they were watering what was left of the playing field from end zone to end zone. >> we noticed there were -- players were playing a lot of sod was being kicked up by their feet. >> reporter: eric watched the

team practice yesterday. >> when the receiver made a cut sod would come up. and we noticed that stevie johnson fell near the end zone and he kind of came up limping and i think that concerned the coaching staff. >> reporter: after that, coach jim harbaugh pulled the players from the field. chopper 5 showed workers on the ground yesterday morning. back in april, the team said it chose a special train of beauty grass because it was drought- resistant and tough. apparently, it didn't stick. >> there can be a situation where the turf doesn't adhere as well as possible. >> reporter: morgan hill sod grower aaron gill didn't work at levi's stadium. but he offers this explanation for the uneven turf. >> it might be a calendar issue where play resumed a little too quick or it might be an issue where the plant's just not taking on. >> reporter: the 9ers have apologized to fans who came out to watch the team play and insist the field will be ready for sunday's game against the san diego chargers. the turf growers west coast

turf say that it's not unusual for them to resod a field. for example, they do it in between college bowls and nfl games. they wouldn't give us the details about this project. but they say that, quote, it is not a big deal. >> but just after a soccer game and one football game it seems kind of strange but at any rate, that particular strain of bermuda grass is used in a number of parks on the west coast and seems to be holding up okay, right? >> reporter: yeah. you know, raiders are using it. the padres. the chargers. stanford. and the minor league ball team in sacramento. no problems that we have heard of as of yet. we'll see how it goes. live at levi's stadium, kiet do, kpix 5. >> we'll find out on sunday. thank you. we have a little football tonight. it's the raiders and packers at 5:00 this afternoon. watch the game right here on kpix 5. [ laughter ] should be a good game and great weather around the bay area looks like for the weekend. we have the 9ers game, too, of course this weekend. going to see a lot of sunshine for that. out the door we go. we have some patchy fog some of that along the coastline and making its way inside the bay. toward the afternoon, though, expecting a whole lot of sunshine. the temperatures may be just slightly cooler but not by much. we're talking two to three degrees. still 80s in the valleys, 70s and low 80s inside the bay and patchy fog probably gathering along the coastline and 60s there. you see the clouds out over the bay right now. temperature of 60 degrees in san francisco. 56 in santa rosa. and 61 degrees in concord. but this afternoon, here comes that sunshine. 80s as you head toward concord. about 80 in san jose. 73 in oakland. and 68 degrees in san francisco. let's check the roads now with elizabeth. >> thank you, lawrence. and we'll take you back out to oakland. so they ran a brief traffic break in order to clear this stall and maybe if you look at the top left of your screen you notice some flashing lights. they cleared it off to the

shoulder now. so suddenly we are seeing a big improvement now in the lanes past the coliseum heading into downtown oakland. so for a while we had a traffic jam but it's cleared. traffic quickly recovered, as well. westbound 580 through the livermore valley heavy through vasco and sluggish out to the dublin interchange. 25 minutes between the altamont pass and 680. that is "kcbs traffic." back to you guys. >> thank you. the first of two dozen cats dumped outside the marin humane society is up for adoption. the remaining 23 will be available in the coming days. the cats and kittens were left anonymously in cardboard boxes in the middle of the night last week. the legally mandated stray hold expired and now people can begin adopting the black and white tuxedo cats. missouri national guard is starting to pull out of ferguson after two weeks of protesting over the fatal shooting of young michael brown. now, the demonstrations have

become more peaceful although seven people were arrested. the missouri highway patrol captain in charge in ferguson visited a makeshift community center and received a special gift. >> the kids that were there today gave me this sock puppet before i left. this is what defines a community. this is truly the community of ferguson. >> state of emergency still officially in place in ferguson. the last three nights have been more calm. locally 100 people marched last night in san francisco. they said it was in an effort to show solidarity with protestors in ferguson, missouri. federal civil complaint. they say new witnesses have come forward in the case. the second protest starts at noon. they are marching over to the federal courthouse to file that complaint. frank and michelle? >> anne, what is known about the police officers involved in the case? >> reporter: unlike the case of michael brown, the san francisco police never released those officer names. we do know that they were put on paid administrative leave. anne makevoc, kpix 5. sacramento hospital is reporting good news. the patient thought to be at risk for ebola virus does not have the disease. the patient had just come back from west africa and came back homesick raising a number of alarms. and some good news for two american patients who did contract the ebola virus. both are back home with their families finally this morning. dr. kent brantly was released from an atlanta hospital yesterday. as you can see he had an emotional receiving there

85 in antioch. should be about 81 in walnut creek. a little breezy through the delta this morning. 70s and 80s there toward the afternoon. could reach 990 degrees in clearlake about 7 -- could reach 90 degrees in clearlake 77 san rafael. downtown san francisco 68 degrees. breaking news in san jose. the fire department is telling us they are on the scene of a grass fire near kelly park and looks like the fire department has that fire mostly out right now. this was called in about 15 minutes ago. no reports of injuries. in kentucky, four firefighters were hurt when their "ice bucket challenge" went wrong. the firefighters were helping a college marching band with the challenge. after they sprayed the students with water, the crew pulled the ladder back and the bucket got too close to a power line. one of them is now in critical condition and power was knocked out in the area. couple of bay area retailers are doing a little better than expected. here now is kcbs radio's financial reporter jason brooks. >> reporter: good morning, frank and michelle. clothing sales have been on the

rise and that's evidences by the quarterly results coming from gap and ross. gap had a solid 2nd quarter. its revenue up 2.8% to nearly $4 billion. old navy was the big winner out of the three chains in the group. its sales were up 4%. banana republic was flat and the flagship gap chain was down by 5%. ross stores also had a nice quarter. its revenue up more than 7% to $2.7 billion. investors are responding shares of both companies surging higher in the early going. reuters is reporting that there could be a snag in the iphone 6 launch that's expected next month from apple. it says that some suppliers are having problems with producing the screens for the new phones which are expected to be bigger. 4.7 and possibly 5.5" versions coming at the launch. it says that key component was redesigned and that halted production of the panels for a bit of time. not clear whether or not that might delay that launch which

just as they get a hand behind the back one of the deputies starts to punch him. watch in slow motion. the deputy punches him in the thigh and then the chest. another deputy appears to be shoving coroso's face into the ground. >> anytime an officer uses force it looks bad. >> reporter: he says it's's justifiable use of force. >> you have to remember when a police officer is in a confrontation there's at least one gun involved the one they are wearing and you never know whether the suspect is armed or not and you do a search of him. >> reporter: the spokesman for the department says the deputies were using distraction jabs. sergeant foshay says that's a tactic to hit a person you're trying to arrest in different places in order to get hold of his hands. >> it looks fairly unnecessary to me. los angeles, a police lawyer says this video showed cops using distraction strikes. after some public backlash, big bratton, the chief at the time, decided to outlaw the use of that term distraction strikes from ever being used at the lapd. they are not allowed to say it. but they're still allowed to do it if the situation calls for it. joe vazquez, kpix 5. >> there will be an internal review but the man hasn't filed a complaint. check of traffic now at 6:49. liz, how are we doing? >> we're doing okay. we have seen a few accidents so far this morning. but a lot of our drive times just about all of them in fact are way down. so yeah, it's pretty "friday light" out there. things are looking good if you have to get to work on time. traveling 101 northbound in san jose you will hit a few brake lights but again better than normal especially for this time of the morning. if you are coming northbound a few slowdowns between capital and 280 and then a little sluggish out past mckee but again if you can use that every day you kind of expect that. and at the bay bridge the

metering lights were turned on right around that 5:45 mark. and you were stacked up through the maze with some loosening up a little closer to the toll plaza. once you get on the bridge it looks okay. all the approaches are also fine, as well. westbound 580, even the eastshore freeway, we're not seeing any huge delays yet out of richmond. if you are traveling the peninsula obviously 101 and 280 both look pretty clear and you can see all green on our sensors. even across the dumbarton bridge, san mateo bridge, everything is still pretty much moving at the speed limit. we can show what you it looks like right now once you get past the san mateo bridge toll plaza. flat section looks good. 14-minute drive time in either direction from end to end. that's your latest "kcbs" drive to work. your weekend forecast, the weekend is here, here's lawrence. looking good for the weekend, too. today we are starting out with some patchy fog but not as extensive as it has been so i think by the afternoon still going to see mostly sunny skies but temperatures may be cooler. out the door the fog assist nevada mo along the coastline and some of that sneaking inside the bay. looking toward the afternoon, skies will become mostly sunny.

temperatures down just a degree or two. and then plenty of sunshine slightly warmer toward the weekend. lopez in the pacific northwest just enough to weaken this ridge so temperatures may cool slightly and reinforce the low clouds and fog out along the coastline. so out toward the beaches a little cool but not bad. 6 the degrees in monterey bay. you head to the central valley, well, 30 degrees warmer into fresno at 99. 89 degrees in sacramento. 90 in yosemite. and 74 degrees in lake tahoe. around the bay today, those temperatures soaring in the 70s and 80s in the south bay. you will see 60s toward the beaches with that patchy fog. and looking toward the east bay numbers well into the 80s inland. a little breezy in through the delta today. the temperatures there in the 70s and the 80s. inside the bay, you're looking at 68 degrees in san francisco. and about 73 degrees in oakland. next couple of days, we are going to see a lot of sunshine after some patchy morning fog temperatures slightly warmer over the weekend but if you like the heat you'll like the middle of next week. mid-90s showing up on tuesday

san francisco on a day of protest against the police shooting that happened five months ago. 28-year-old alex nieto of san francisco was shot and killed by police at the top of the hill at bernal heights park. about two dozen people held a ceremony here this morning. it was a friday night at about 7 p.m. when police got a report of a man looking suspicious. they arrived and officers say nieto pulled a taser on them and they thought it was a gun. >> these officers were involved in the shooting get reprimanded for what they did. >> reporter: today lawyers for the family will file a federal civil complaint. they say a new witness has come forward in the case. so they are starting a march here at the park at noon. they are walking to the federal building in san francisco where that are complaint will be filed. live in san francisco, anne makevoc, kpix 5. and a final check of your "kcbs" drive to work. we don't have any hot spots out the door so traveling out of
